- In the case of injury to a victim other than serious bodily injury, the hit and run driver has committed a felony in the third degree
- In the case of serious bodily injury to a victim, the hit and run driver has committed a felony in the second degree
- In the event of the death of a victim, the hit and run driver has committed a felony in the first degree
