The time you have to file an auto accident claim depends upon what happened. If a person dies in an auto accident in Florida, you must file within two years of the date of death. If someone’s injured, then the statute of limitations is four years. If you’re suing, you’re uninsured or an underinsured motorist carrier then you have five years in the state of Florida to sue.
