Bulldogs Attack Women And Kill Her Dog
Two Hollywood women were attacked by bulldogs recently during a tragic incident while the one woman was out walking her terrier. The bulldogs broke loose and began to attack the woman walking her dog; a second woman ran to assist her and was also attacked by the bulldogs. Both women suffered injuries as a result of the attack and required hospitalization. Sadly, the terrier was mauled during the attack as well and died as a result. According to the news report, the bulldogs’ owner said that his dogs were trained to hunt, but had never attacked anyone before. The bulldogs were initially quarantined because of the attack but ended up having to be turned over to animal control. The entire incident is certainly a tragedy for all those involved.
Florida’s Dog Bite Laws
Under Florida law, the owner of a dog that bites someone is liable for any resulting injuries, regardless of whether the dog has any history of biting people in the past or if the dog owner knows of any such vicious behavior of the dog. If the dog bite attack is the result of some negligence of the victim, such as provocation, or if the attack occurs during a time when the victim is unlawfully on the dog owner’s property, there are exceptions to the extent to which the dog’s owner would bear full responsibility for the damages. From the description of the bulldog attack in this case, it does not seem as though any of these exceptions were present.
Dangerous Dog Registration
Florida Code Section 767.12 provides for a procedure by which dogs are classified as dangerous and registered as such. Once a dog has been classified and registered as a dangerous dog, the owner is required to follow the specific requirements for confinement and containment of the dog as set forth in the law. If the dog subsequently attacks or bites someone, the owner can be charged with a misdemeanor; depending upon the extent of the injuries, this charge can be elevated to a felony. Additionally, the law provides for the dangerous animal to be destroyed – quickly, but humanely – after such an incident. This is, of course, something that no dog owner ever wants to have happen to his or her pet, and is a good argument for making sure that if your dog has been classified as dangerous, that you take every measure to prevent the dog from having the opportunity to bite and injure someone.
