Brain injuries occur in all types of accidents around the world. They occur in car accidents when drivers and passengers are rear-ended, struck from the side or roll over. They occur in motorcycle accidents even when riders are wearing helmets. They occur at amusement parks on rides or in slip and fall accidents. In the United States, 1.7 million new traumatic brain injuries occur each year, and these account for more than one third of all injury-related deaths.

Traumatic brain injuries
Traumatic brain injuries, frequently called TBIs, are caused when a bump, blow, jolt or other forceful movement causes the brain to move back and forth within the skull and disrupts normal functioning. Traumatic brain injuries may also be caused by penetrating injuries to the head. Many types of injuries may result from trauma to the head, including:

Damage to the brain caused by these injuries can also result in additional harm, although many of these injuries may be prevented or reduced through prompt medical care. Many additional injuries may occur after the initial trauma, such as:

In certain cases, brain damage may result in a persistent vegetative state or the victim may be declared brain dead. In these cases, our attorneys assist the victim’s legal representative or family members with suing on the victim’s behalf.
Common causes of traumatic brain injuries
The most common cause of traumatic brain injuries in the United States is falls. Falls cause half of all TBIs in children and more than 60 percent of TBIs in older adults. Motor vehicle accidents are the second most common cause of head injuries, and these accidents result in the largest percentage of deaths related to brain injuries. These include all types of car accidents, truck accidents, pedestrian accidents and other traffic accidents. Motorcycle accidents can be particularly dangerous, especially since Florida does not require riders to wear helmets.
A person may suffer a TBI when they are struck by or against an object, which may be stationary or moving. This includes collisions in sports or athletic activities. Assaults also contribute to 10 percent of all TBIs and may give rise to a personal injury claim or a premises liability claim if the victim was injured because of negligent security.
Acquired brain injuries
Acquired brain injuries, often called ABIs, are a type of head injury that is caused by a lack of oxygen to the brain. Many types of accidents may cause acquired brain injuries, including medical malpractice during the birthing process, failure to diagnose or other negligent treatment. One of the most common causes of ABIs is drowning accidents. Florida law has extensive safety requirements for new swimming pools, including at least one of the following proper enclosures:
- Pool safety covers
- Exit alarms on doors
- Self-closing, self-latching devices on all gates or entries to the pool
If you or your child has suffered a brain injury in a drowning accident because of negligence or violations of the law by others, our attorneys can help you obtain the compensation you need for these and other catastrophic injuries.
